12. Notice For California Consumers

Under California Civil Code Section 1789.3, California Users of this website upon use of applicable services (as defined by California Civil Code Section 1789.2) may file a complaint regarding an applicable service and receive further information on resolving such complaints from the Complaint Assistance Unit of the Division of Consumer Services of the Department of Consumer Affairs online at http://www.dca.ca.gov/ or call 800.952.5210 to have a complaint form mailed to you.

13. Dispute Resolution

Any dispute concerning these Terms or the services provided by Converse must only be resolved by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator applying California law and administered by the American Arbitration Association, in a location mutually agreed upon by the parties. If the Parties cannot agree on a location, the arbitration will be conducted telephonically. The arbitrator's award will be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms, the prevailing party will be entitled to recover its costs and reasonable attorney's fees. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms.

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

14. Changes to Terms

Converse reserves the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.

15. DMCA Compliance

Converse respects the intellectual property rights of others and expects its users to do the same. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and will respond to valid notices of alleged infringement.

a. Notification of Infringement

If you believe that your copyrighted work has been uploaded, linked to, or otherwise made accessible through our service without authorization, you may submit a notice of infringement to team@getconverse.com, including all required details.

b. Counter-Notification

If you believe that content you posted on our service was removed or disabled by mistake or misidentification, you may send us a counter-notice with your contact information, a full description of the content, and the location where it appeared before it was removed.

c. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Converse has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
